A father and his adopted son want to marry.
“If you asked Nino Esposito and his partner five years ago when they thought same-sex marriage would be legal, they’d say the day would never come.
“Prior to the Supreme Court’s legalization of same-sex marriage nationwide, many gay couples used adoption laws as a way to gain legal family ties in order to get benefits, as reported by CNN.
“This was the case for Esposito, a retired teacher, and his now adopted partner Roland ‘Drew’ Bosee, a former freelance and technical writer. The couple went through with the adoption in 2012 after 40 years of being together.
“The couple is now trying to reverse the adoption in order to get married, but a state court judge has rejected that request saying adoption annulments are generally limited to cases of fraud.”
If law prohibits parent and child marriage, even when they are not blood related, than it prohibits parent and child marriage. If a mother can not marry her adopted son, or a father his adopted daughter, than then prohibiting these two is exactly what real “marriage equality” looks like.
The ACLU has already demanding that a same sex parent child marriage be allowed because clearly “some… are more equal than other” it would seem.
This is close to the realization of an argument that I have used for years to point out the absurdity of SSM and why marriage is about children even if not explicitly stated in law.
As far as I know, every state, even Arkansas, have laws prohibiting incestuous marriage. The reason that even SSM supporters will tell you for these laws is that the children of incestuous relationships have a much higher incidence of congenital defects. Also, most will just say, “yuck”. But if the purpose of this prohibition is to protect children, then obvious such prohibition is not necessary for SSM as there can be no natural children from such a “marriage”. So now you have a situation where two brothers or two sisters or a father and son or mother and daughter wish to marry, to express their love of course, but cannot because the law does not distinguish between types of “marriage”. They will sue and liberal justices will agree with them (because dignity I guess, thank you Anthony Kennedy) and open up a loop hole. Now a heterosexual incestuous couple will sue because now they are not treated equally under the law. The slippery slope has now tilted to almost be a cliff.
