Burwell, another federal court concluded that the IRS rule authorizing tax credits and cost-sharing subsidies for the purchase of health insurance in federal exchanges violates the text of the PPACA. In reaching this result, Judge White of the U.S. District Court for the Eastern District of Oklahoma concurred with the initial panel decision of the U.S. Court of Appeals for the D.C. Circuit in Halbig v. Burwell and rejected the conclusions of the U.S. Court of Appeals for the Fourth Circuit in King v. Burwell. A fourth case against the IRS rule remains pending in federal district court in Indiana.<\/p>\n
\nIf you’re coming in late to this, or have forgotten, this concerns the IRS granting those who enroll into Obamacare in the federal exchanges the same subsidies as are granted to those who enroll in the state exchanges.<\/p>\n
\nIn concluding his ruling, the judge in Pruitt takes time to note the “apocalyptic language” used by the dissent in Halbig (the DC circuit case in which the majority found similarly that the IRS had acted lawlessly).<\/p>\n

His HBO special specializes in the \u201clong-form\u201d takedown, with 15-minute segments devoted to a single topic (one of his best segments was on FIFA, soccer\u2019s international governing body). He\u2019s the toast of many on the left, who see him as giving subjects the in-depth treatment that Jon Stewart can\u2019t. But what happens when he aims both barrels of mockery at a subject he just doesn\u2019t understand?<\/p>\n
