{"id":3946,"date":"2013-11-18T01:46:01","date_gmt":"2013-11-18T08:46:01","guid":{"rendered":"http:\/\/politicalhat.com\/?p=3946"},"modified":"2013-11-18T01:46:01","modified_gmt":"2013-11-18T08:46:01","slug":"enda-paragon-of-intolerance","status":"publish","type":"post","link":"https:\/\/impeachreno.org\/politicalhat\/2013\/11\/18\/enda-paragon-of-intolerance\/","title":{"rendered":"ENDA: Paragon of Intolerance"},"content":{"rendered":"<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The Senate passed the &#8220;Employee Non-Discrimination Act&#8221; which <a href=\"http:\/\/www.redstate.com\/2013\/11\/04\/enda-moral-bankruptcy-and-failed-senate-leadership\/\" target=\"_blank\">purportedly<\/a> bans discrimination on the basis of sexual orientation and &#8220;gender identity.&#8221;<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The ironic thing is that the so-called &#8220;Employee Non-Discrimination Act&#8221; is itself a paragon of <a title=\"It Was NEVER About Tolerance\u2026\" href=\"https:\/\/impeachreno.org\/politicalhat\/2013\/08\/06\/it-was-never-about-tolerance%e2%80%a6\/\" target=\"_blank\">discrimination<\/a>.\u00a0 It requires people, as a condition of running a business with employees, to suspend their inalienable rights to freedom of speech and of religion.\u00a0 It destroys the ability of private parties to make their own <a href=\"http:\/\/www.heritage.org\/research\/reports\/2013\/11\/enda-threatens-fundamental-civil-liberties\" target=\"_blank\">moral judgements<\/a>:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">&#8220;While the government must respect equality before the law, private actors should be free to make reasonable judgments and distinctions\u2014including reasonable moral judgments and distinctions\u2014in their economic activities. Citizens should be free to live their professional lives according to their moral and religious beliefs.&#8221;<\/p>\n<\/blockquote>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-3947\" title=\"It's the Law!!1!\" src=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2013\/11\/ENDA_law.jpg\" alt=\"\" width=\"216\" height=\"387\" srcset=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2013\/11\/ENDA_law.jpg 216w, https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2013\/11\/ENDA_law-167x300.jpg 167w\" sizes=\"auto, (max-width: 216px) 100vw, 216px\" \/><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Unlike race, sexual preference\/orientation is, by definition, linked to actions.\u00a0 If this were just a proposed law that bans discrimination against someone for <em>being<\/em> gay, that would be one thing.\u00a0 The problem is that it enshrines the <em>choice<\/em> to engage in sexual acts as being protected to the point where you can effectively force acceptance on others.\u00a0\u00a0 Further, that choice is <a href=\"http:\/\/www.heritage.org\/research\/reports\/2013\/11\/enda-threatens-fundamental-civil-liberties\" target=\"_blank\">hardly objective<\/a>:\u00a0 &#8220;It would impose liability on employers for alleged &#8216;discrimination&#8217; based not on objective employee traits, but on subjective and unverifiable identities.&#8221;\u00a0 Further, the definitions ENDA uses are nebulous:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><!--more-->&#8220;ENDA defines &#8216;sexual orientation&#8217; as &#8216;homosexuality, heterosexuality, or bisexuality&#8217; but offers no definition of those terms or what principle limits &#8216;orientation&#8217; to those three. Likewise, ENDA defines &#8216;gender identity&#8217; as &#8216;the gender-related identity, appearance, or mannerisms or other gender-related characteristics of an individual, with or without regard to the individual\u2019s designated sex at birth.&#8217; In other words, unlike previous versions of the bill, ENDA\u2019s current incarnation now creates special rights for transgendered individuals\u2014males who dress and act as females and females who dress and act as males\u2014and forbids employers from considering the consequences of such behavior at the workplace.<\/p>\n<p style=\"text-align: justify;\">&#8220;\u2026<\/p>\n<p style=\"text-align: justify;\">&#8220;[U]nlike race, sexual orientation and gender identity are usually understood to include behaviors. An employer\u2019s decisions reasonably taking into account the behavior of employees are core personnel decisions best left to businesses themselves, not to the federal government.<\/p>\n<p style=\"text-align: justify;\">&#8220;\u2026 Compounding these legal problems is the fact that sexual orientation and gender identity are unclear, ambiguous terms. They can refer to voluntary behaviors as well as thoughts and inclinations, and it is reasonable for employers to make distinctions based on actions. Consequently, ENDA would prohibit reasonable decisions to base employment on behavior. By contrast, \u201crace\u201d and \u201csex\u201d clearly refer to traits, and in the overwhelming majority of cases, these traits (unlike voluntary behaviors) do not affect fitness for any job.&#8221;<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Further, it would <a href=\"What the State Forbids and What the State Compels\" target=\"_blank\">force people to lie<\/a>.\u00a0 If a man wants to call himself a woman, than it would be <a href=\"When Affirmation is Mandatory, And Silence is Oppression\" target=\"_blank\">illegal<\/a> to refer to him as a &#8220;him&#8221; because it would cause a &#8220;hostile work environment.&#8221;\u00a0 It even goes beyond work, since the City of San Antonio has <a title=\"The Bias of \u201cAnti-Bias\u201d Laws\" href=\"https:\/\/impeachreno.org\/politicalhat\/2013\/09\/10\/the-bias-of-anti-bias-laws\/\" target=\"_blank\">banned employment<\/a> for anyone who has ever said a politically incorrect thing.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;When it comes to possible <a href=\"http:\/\/www.powerlineblog.com\/archives\/2013\/11\/where-will-it-all-enda.php\" target=\"_blank\">litigation<\/a>, there hasn&#8217;t been much in states that adopted ENDA style legislation, which &#8220;[f]rom a conservative point of view, however, it&#8217;s an argument for not legislating. The flood of litigation that followed the ban on race discrimination in employment, once that ban got some teeth, confirmed the need for such legislation. Lack of litigation suggests lack of need.&#8221;\u00a0 But then, perhaps why we haven&#8217;t seen much litigation, yet, is because supporters of ENDA don&#8217;t want to spook people by a bevy of lawsuits against people\u2026 or perhaps those who are gay or transvestites at least have the decency to let others live their own life (for now at any rate).<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;This isn&#8217;t about &#8220;equality.&#8221;\u00a0 It is about purging society of its norms and values and replacing it with a false equality.\u00a0 Men are not women, and women are not men.\u00a0 The Progressive idea of &#8220;Kyriarchy&#8221; maintains that straight and &#8220;cis-gendered&#8221; individuals can <em>never<\/em> be <a title=\"Kyriarchy and the Supreme Court\" href=\"https:\/\/impeachreno.org\/politicalhat\/2013\/10\/21\/kyriarchy-and-the-supreme-court\/\" target=\"_blank\">discriminated<\/a> against because of their &#8220;privilege.&#8221;\u00a0 Thus, ENDA is clearly about elevating some people, and their voluntary behaviors, receive <em>special<\/em> and <a href=\"http:\/\/mypetjawa.mu.nu\/archives\/217233.php\" target=\"_blank\">unequal protection<\/a>.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;It all comes back to the notion that &#8220;gender is a social construct&#8221; (which itself is a social construct).\u00a0 On that basis, the only difference between the biological sexes is who has what reproductive organs.\u00a0 Even there, the LGBTQ political advocates wish to deny the basic science of biology!\u00a0 EDNA refers to ones &#8220;sex assigned at birth&#8221; as if it were a <a href=\"http:\/\/thefederalist.com\/2013\/11\/08\/enda-government-identity-crisis\/\" target=\"_blank\">choice<\/a> of the parents or doctors.\u00a0 In California, a gay couple can receive &#8220;infertility treatment&#8221; if they can&#8217;t naturally have a child between them!<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;It is this warped ideology that there must be no gender\/sex distinction whatsoever that is false and oppressive.\u00a0 There are <a title=\"Progressive Hypocrisy: Equality of the Sexes\" href=\"https:\/\/impeachreno.org\/politicalhat\/2013\/10\/17\/progressive-hypocrisy-equality-of-the-sexes\/\" target=\"_blank\">differences<\/a>, both physically and physiologically.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;This false equality contradicts nature and basic biological science &#8211;
