{"id":3751,"date":"2013-10-21T19:10:27","date_gmt":"2013-10-22T02:10:27","guid":{"rendered":"http:\/\/politicalhat.com\/?p=3751"},"modified":"2013-11-17T21:30:52","modified_gmt":"2013-11-18T04:30:52","slug":"kyriarchy-and-the-supreme-court","status":"publish","type":"post","link":"https:\/\/impeachreno.org\/politicalhat\/2013\/10\/21\/kyriarchy-and-the-supreme-court\/","title":{"rendered":"Kyriarchy and the Supreme Court"},"content":{"rendered":"<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;One of the dimensions of &#8220;<a title=\"Kyriarchy\" href=\"https:\/\/impeachreno.org\/politicalhat\/2013\/01\/30\/kyriarchy\/\" target=\"_blank\">Kyriarchy<\/a>&#8221; and the belief in &#8220;White Privilege&#8221; is that White people are innately racist while non-Whites can <em>never<\/em> be racist.\u00a0 As a corollary, this means that non-Whites are <em>always<\/em> victims of racism while Whites can <em>never <\/em>be victims of racism.\u00a0 This is, of course, patently <a href=\"http:\/\/theboxout.wordpress.com\/2013\/07\/07\/can-white-people-be-victims-of-racism\/\" target=\"_blank\">absurd<\/a>.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;But it is this delusional ideology that declares that racial equality is not only innately discriminatory, but actually in <a href=\"http:\/\/www.commentarymagazine.com\/2013\/10\/14\/is-racial-equality-unconstitutional-affirmative-action-scotus-michiga\/\" target=\"_blank\">violation<\/a> of the Constitution&#8217;s guarantee of equality under the law, and thus <a href=\"https:\/\/impeachreno.org\/politicalhat\/2013\/09\/05\/when-equality-if-racist\/\" target=\"_blank\">racist<\/a>!<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The Supreme Court recently heard arguments over the case of <a href=\"https:\/\/impeachreno.org\/politicalhat\/2013\/09\/05\/when-equality-if-racist\/\" target=\"_blank\">Schuette v. BAMN<\/a>, where a ban on racial discrimination is being challenged as being Unconstitutional!<\/p>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-3144\" title=\"scales-of-justice\" src=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2013\/08\/scales-of-justice.jpg\" alt=\"\" width=\"168\" height=\"300\" \/><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;James Taranto <a href=\"http:\/\/online.wsj.com\/news\/articles\/SB10001424052702303680404579139601418956802\" target=\"_blank\">points out<\/a> a telling <a href=\"http:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/12-682_l537.pdf\" target=\"_blank\">exchange<\/a> between the attorney, Shanta Driver, for the contradictorily named &#8220;Coalition to Defend Affirmative Action, Integration and Immigrant Rights and Fight for Equality by Any Means Necessary, or BAMN&#8221; and Antonin Scalia:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><!--more--><strong>Driver<\/strong>: We ask this Court to uphold the Sixth Circuit decision to reaffirm the doctrine that&#8217;s expressed in Hunter-Seattle, and to bring the 14th Amendment back to its original purpose and meaning, which is to protect minority rights against a white majority, which did not occur in this case.<\/p>\n<p style=\"text-align: justify;\"><strong>Scalia<\/strong>: My goodness, I thought we&#8217;ve&#8211;we&#8217;ve held that the 14th Amendment protects all races. I mean, that was the argument in the early years, that it protected only&#8211;only the blacks. But I thought we rejected that. You&#8211;you say now that we have to proceed as though its purpose is not to protect whites, only to protect minorities?<\/p>\n<p style=\"text-align: justify;\"><strong>Driver<\/strong>: I think it is&#8211;it&#8217;s a measure that&#8217;s an antidiscrimination measure.<\/p>\n<p style=\"text-align: justify;\"><strong>Scalia<\/strong>: Right.<\/p>\n<p style=\"text-align: justify;\"><strong>Driver<\/strong>: And it&#8217;s a measure in which the question of discrimination is determined not just by&#8211;by power, by who has privilege in this society, and those minorities that are oppressed, be they religious or racial, need protection from a more privileged majority.<\/p>\n<p style=\"text-align: justify;\"><strong>Scalia<\/strong>: And unless that exists, the 14th Amendment is not violated; is that right? So if you have a banding together of various minority groups who discriminate against&#8211;against whites, that&#8217;s okay?<\/p>\n<p style=\"text-align: justify;\"><strong>Driver<\/strong>: I think that&#8211;<\/p>\n<p style=\"text-align: justify;\"><strong>Scalia<\/strong>: Do you have any case of ours that propounds that view of the 14th Amendment, that it protects only minorities?
