{"id":2274,"date":"2013-05-23T14:37:44","date_gmt":"2013-05-23T21:37:44","guid":{"rendered":"http:\/\/politicalhat.com\/?p=2274"},"modified":"2013-05-23T14:37:44","modified_gmt":"2013-05-23T21:37:44","slug":"the-problem-is-not-lack-of-regulation","status":"publish","type":"post","link":"https:\/\/impeachreno.org\/politicalhat\/2013\/05\/23\/the-problem-is-not-lack-of-regulation\/","title":{"rendered":"The Problem is Not Lack of Regulation"},"content":{"rendered":"<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Two recent disasters, the collapse of the Bangladeshi building and the West (Texas) ammonium nitrite explosion, are being held up as examples of unregulation run amok, with heavy regulation being the proffered solution.<\/p>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2275\" title=\"redtape\" src=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2013\/05\/redtape.jpg\" alt=\"\" width=\"450\" height=\"300\" srcset=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2013\/05\/redtape.jpg 450w, https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2013\/05\/redtape-300x200.jpg 300w\" sizes=\"auto, (max-width: 450px) 100vw, 450px\" \/><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The problem, in both cases, was not due to sheer lack of regulation, but of regulations that were either unenforced, or so badly construed as to be misregulation.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The Bangladeshi factory building collapse, which killed hundreds is one such example.\u00a0 Official permits were not obtained, and the <a href=\"http:\/\/www.guardian.co.uk\/world\/2013\/apr\/25\/bangladesh-building-collapse-anger-search\" target=\"_blank\">very construction of the building was outright illegal<\/a>.\u00a0 Illegal &#8220;<a href=\"http:\/\/www.reuters.com\/article\/2013\/04\/26\/us-bangladesh-building-idUSBRE93N06P20130426\" target=\"_blank\">local permission<\/a>&#8221; was gained through corrupt political connections.\u00a0 Further that &#8220;local permission&#8221; was only for a five story building, while the actual building had <em>three additional stories<\/em> than even that illegal permit allowed for.\u00a0 The factory was also located <em>outside<\/em> an industrial zone, and thus was outright illegal to build.<\/p>\n<p style=\"text-align: justify;\"><!--more-->&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;This tragedy was not caused by lack of regulation, but of violating existing regulations.\u00a0 What use of additional regulations be, if officials aren&#8217;t willing to, or are unable to, enforce the ones that currently exist.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;A second example is the ammonium nitrate (NH<sub>4<\/sub>NO<sub>3<\/sub>) explosion at the fertilizer plant in West, Texas.\u00a0 The problem wasn&#8217;t that a plant with so much ammonium nitrate wasn&#8217;t regulated, but that it <a href=\"http:\/\/mediamatters.org\/research\/2013\/04\/23\/report-cable-news-ignores-tx-fertilizer-plants\/193735\" target=\"_blank\">skirted the regulations<\/a> that were already on the books: The fertilizer plant has <a href=\"http:\/\/usnews.nbcnews.com\/_news\/2013\/04\/20\/17838304-red-flag-texas-plant-had-1350-times-amount-of-chemical-that-would-trigger-oversight?lite\" target=\"_blank\">1350 times the amount of NH<sub>4<\/sub>NO<sub>3<\/sub><\/a> that triggers Dept. of Homeland Security oversight.\u00a0 In other words, what the plant was doing was already illegal, as well as being <a href=\"http:\/\/www.reuters.com\/article\/2013\/04\/20\/us-usa-explosion-regulation-idUSBRE93J09N20130420\" target=\"_blank\">regulated<\/a>.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The problem was not lack of <a href=\"http:\/\/www.agweb.com\/article\/regulations_not_at_fault_in_texas_explosion_officials_say\/\" target=\"_blank\">regulations on the book<\/a>s, but the <a href=\"http:\/\/www.bloomberg.com\/news\/2013-04-26\/texas-town-s-blast-crater-shows-risk-from-patchwork-zoning-laws.html\" target=\"_blank\">patchwork and often contradictory regulations<\/a> and requirements that make it difficult comply, even if one honestly tries to do so.\u00a0 That this particular plant was already known to have a <a href=\"http:\/\/www.cnn.com\/2013\/04\/25\/us\/texas-explosion-plant\" target=\"_blank\">history of problems<\/a>, known to regulators, merely emphasizes that the problem is not with lack of regulation, but with misregulation.<a href=\"http:\/\/www.cnn.com\/2013\/04\/25\/us\/texas-explosion-plant\"><\/a><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Regulations which both provide for a minimal level of safety <em>and<\/em> can be easily adhered to, by both those who are regulated, and those who regulate, is optimal.\u00a0 Problems arise when following regulations become so burdensome, that breaking the law becomes the easiest solution; problems also arise when those who enforce the regulations are either unable to, or unwilling to, actually enforce the laws on the book.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;More is not better.\u00a0 Seek reform of current regulations, not simply the blind multiplication of the labyrinthine red tape that allowed these tragedies to happen.<\/p>\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Two recent disasters, the collapse of the Bangladeshi building and the West (Texas) ammonium nitrite explosion, are being held up as examples of unregulation run amok, with heavy regulation being the proffered solution. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The problem, in both cases, was not &hellip;
