The Unfettering Nascent<\/p><\/div>\n

     In this age of wokeness, its pseudo-Hegelian antithesis anti-wokeness practically requires an equal and opposite response, where non-woke \u201ccuckservatives\u201d are labeled<\/a> as being pro-woke for \u201cfighting with one arm behind their backs\u201d or even acknowledging the de facto<\/em> article of pseudo-faith that the laws have all already<\/em> been flattened, so engaging in by any means necessary<\/em>\u2014allegedly\u2014is but turnabout being fair play<\/a>. However, in reality, this is more akin to the belief that if you can\u2019t beat \u2018em, join \u2018em<\/em>.<\/p>\n

     There is no better example of the the \u201cfightin\u2019 right\u201d willing to toss aside<\/a> the core pillars<\/a> of the superficial<\/a> structure<\/a> they claim to protect, than the embrace of Texas\u2019 scheme<\/a> to impose its will while avoiding all legal challenges by tossing out a core Common Law precept of standing<\/em> by allowing all non-governmental<\/em> actors to enforce a de facto<\/em> criminal law in a de jure<\/em> civil action by threat of civil penalties by private citizen who so empowered<\/em> by the state as de facto<\/em> quasi-agents<\/em> of the state.<\/p>\n

     The argument for this is, unsurprisingly<\/a>, that we must destroy<\/em> the Constitution\u2014with its protection of rights, legal protections, and the rule of law\u2014in order to protect <\/em>the Constitution.<\/p>\n

\n

\u201cGood. Good riddance to Section 230, Roe, Casey, and other laws that now shield the grossest abuses of constitutional rights. They will be emasculated by the civil remedy, a cure that is creative and constitutional, and should be adopted nationwide to cement conservative priorities in states. Though Democrats will now use the same approach for their own designs \u2014 e.g., California Governor Gavin Newsom, who promised to use the civil-remedy approach to ban assault weapons \u2014 consistency was never a defense against them, anyway. The cat\u2019s now out of the bag, and they shall have to be defeated at the ballot box.\u201d<\/p>\n<\/blockquote>\n

     The concept of \u201cconstitutional rights\u201d, then, devolves the Constitution into a \u201cfour legs good; two legs bad<\/a>\u201d mentality. While Roe and Casey were unfounded in the Constitution, the Common Law, or even ration reasoning, the much derided Section 230<\/a> is\u2014far from one of the \u201cgrosses abuses of constitutional rights\u201d\u2014an equally applicable rule of law the protects all equally\u2026 especially the \u201clittle guy\u201d.<\/p>\n

     Perhaps more threatening<\/a> is the daftness<\/a> of those who think the the laws have already been laid flat, and that by going all out they have nothing to lose and everything to<\/span> that will be <\/em>gained<\/a>.<\/p>\n

\n

\u201cWherever it\u2019s feasible, though, Republicans must show gumption in standing up for constitutional rights against a daft but deft Left that wants to take them away. This is one strategy.\u201d<\/p>\n<\/blockquote>\n

     This is not a \u201cstrategy\u201d, but a full-on co-belligerency of many of the foundational values of America<\/a> that conservatives seek to conserve<\/a>. This is not fighting\u2014it is flailing in desperation<\/a>. And in their ignorance, if they do \u201csucceed\u201d, that they will find out that the laws were not all laid flat before, but they are now<\/em>.<\/p>\n
