{"id":17785,"date":"2021-03-22T14:41:39","date_gmt":"2021-03-22T21:41:39","guid":{"rendered":"http:\/\/politicalhat.com\/?p=17785"},"modified":"2021-03-22T14:41:39","modified_gmt":"2021-03-22T21:41:39","slug":"anti-gun-bill-puts-nevada-ccw-permit-holders-in-jeopardy","status":"publish","type":"post","link":"https:\/\/impeachreno.org\/politicalhat\/2021\/03\/22\/anti-gun-bill-puts-nevada-ccw-permit-holders-in-jeopardy\/","title":{"rendered":"Anti-Gun Bill Puts Nevada CCW Permit Holders In Jeopardy"},"content":{"rendered":"<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;One of the adages that sadly tends to be far more accurate than not when it comes to state legislatures is the \u201cno man\u2019s life, liberty, or property is safe while the legislature is in session\u201d.<\/p>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2021\/03\/no-mans-life-liberty-or-property-is-safe-while-the-legislature-is-in-session.jpg\" alt=\"\" width=\"600\" height=\"400\" class=\"aligncenter size-full wp-image-17786\" srcset=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2021\/03\/no-mans-life-liberty-or-property-is-safe-while-the-legislature-is-in-session.jpg 600w, https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2021\/03\/no-mans-life-liberty-or-property-is-safe-while-the-legislature-is-in-session-300x200.jpg 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The Nevada Legislature is no different these days, especially when it comes to gun rights. \u00a0 Democrats have introduced an anti-gun bill, <a href=\"https:\/\/www.leg.state.nv.us\/App\/NELIS\/REL\/81st2021\/Bill\/7778\/Overview\" target=\"_blank\" rel=\"noopener\">AB286<\/a>, that would prohibit home-made guns, but more frighteningly could turn law abiding concealed carry weapon permit holders as well as anyone who open carries a handgun into felons and deny them a fundamental Constitutional right. Specifically:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cSection 2 of this bill establishes similar provisions which make it unlawful for a person to possess a firearm on a covered premises without the written consent of the owner or operator of the covered premises or an agent thereof after being warned by the owner, operator or agent that possessing the firearm on the covered premises is prohibited.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;But business owners ought to have the right to prohibit guns in their own businesses, some may say. \u00a0 The thing is\u2026 businesses <em>already<\/em> have the right to prohibit guns and kick out someone carrying a gun. \u00a0 What this bill does is impose sever criminal penalties against people who are trying to obey the law due to the badly written language of the bill.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The criminal penalties kick in once a person has been \u201cwarned by the owner, operator or agent that the person is prohibited from possessing the firearm on the covered premises\u201d. The problem is that posting a sign \u201cin a conspicuous place at the covered premises\u201d or receiving a document at a public accommodation facility is the only warning, without defining what a \u201cconspicuous place\u201d is or require the sign itself to be conspicuous!<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;To make matters worse, this \u201ccovered premises\u201d includes the entire property, including a parking lot, and even potentially common areas of residential properties. \u00a0 Furthermore, there is no requirement that the \u201cconspicuous place\u201d be viewable before on enters into or onto the \u201ccovered premises\u201d. A person who has to enter into or onto the premises to even potentially see the warning will, according to a broad yet possible reading of this bill, become a criminal automatically without warning, potentially becoming a felon even if they did not see any warning because it wasn&#8217;t viewable from the part of the property a person enter into or onto, or if they immediately leave from said property after seeing the warning.
