{"id":17781,"date":"2021-03-23T15:59:17","date_gmt":"2021-03-23T22:59:17","guid":{"rendered":"http:\/\/politicalhat.com\/?p=17781"},"modified":"2021-03-23T15:59:17","modified_gmt":"2021-03-23T22:59:17","slug":"the-dangerous-wokeness-of-the-george-floyd-justice-in-policing-act","status":"publish","type":"post","link":"https:\/\/impeachreno.org\/politicalhat\/2021\/03\/23\/the-dangerous-wokeness-of-the-george-floyd-justice-in-policing-act\/","title":{"rendered":"The Dangerous Wokeness of the George Floyd Justice in Policing Act"},"content":{"rendered":"<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-17276\" src=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2020\/11\/department-of-social-justice.jpg\" alt=\"\" width=\"225\" height=\"225\" srcset=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2020\/11\/department-of-social-justice.jpg 450w, https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2020\/11\/department-of-social-justice-300x300.jpg 300w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;In the quest to achieve \u201c<a href=\"https:\/\/impeachreno.org\/politicalhat\/2020\/01\/14\/los-angeles-to-go-full-in-with-racial-equity\/\" target=\"_blank\" rel=\"noopener\">equity<\/a>\u201d and \u201csocial justice\u201d to policing, the Left has embraced the concept of \u201c<a href=\"https:\/\/impeachreno.org\/politicalhat\/2020\/11\/09\/woke-doctrine-of-equity-coming-to-the-department-of-justice\/\" target=\"_blank\" rel=\"noopener\">disparate impact<\/a>\u201d where any variance in crime statistics involving race <em>vis-\u00e0-vis<\/em> racial demographic statistics is presumed to be caused by racism. \u00a0 The proposed <a href=\"https:\/\/www.nationalreview.com\/corner\/the-george-floyd-quotas-in-policing-act\/\" target=\"_blank\" rel=\"noopener\">George Floyd Justice in Policing Act<\/a> would make this, and worse, mandatory nationwide.<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cFirst, that a disparate impact by race or sex in traffic stops is considered prima facie evidence of racial profiling. Second, that because disparate impact alone is enough to get a police department in trouble, the police will have an incentive either to stop Asian and female motorists who are not speeding, or not to stop black and male motorists who are speeding, all in an effort to \u201cget their numbers right.\u201d<\/p>\n<p style=\"text-align: justify;\">\u201cReaders won\u2019t be surprised to learn that this isn\u2019t the only ill-considered provision in the bill. Two additional troublesome provisions are connected: taxpayer-funded giveaways to ethnic-advocacy organizations and the imposition of racial preferences in hiring police officers.<\/p>\n<p style=\"text-align: justify;\">\u201cSections 111\u2013114 are taxpayer-funded giveaways to wealthy progressive organizations such as the NAACP, the ACLU, UnidosUS (formerly La Raza), the National Urban League, the National Congress of American Indians, and the National Asian Pacific American Legal Consortium. These \u201ccommunity-based organizations\u201d will receive grants from the attorney general to study various law-enforcement topics, including racial profiling, residency requirements, compensation and benefits, youth justice, hiring and recruitment, etc.<\/p>\n<p style=\"text-align: justify;\">\u201cThese studies are supposed to result in pilot programs that will fulfill accreditation standards (because the legislation will also require police departments to be accredited by certain law-enforcement organizations). The pilot programs will train police departments to meet accreditation standards in the areas of: \u201cinvestigation of officer misconduct and practices and procedures for referring to prosecuting authorities allegations of officer use of excessive force or racial profiling; disproportionate contact by law enforcement with minority communities . . . community relations and bias awareness,\u201d among other things. The pilot programs will also develop \u2018policies, procedures, and practices for the hiring and recruitment of diverse law enforcement officers who are representative of the communities they serve;\u2019 and \u2018the development of selection, promotion, educational, background, and psychological standards that comport with Title VII of the Civil Rights Act of 1964.\u2019<\/p>\n<p style=\"text-align: justify;\">\u201c\u2026<\/p>\n<p style=\"text-align: justify;\"><!--more-->\u201cThere shouldn\u2019t be any racial discrimination in hiring of police officers, just as there shouldn\u2019t be racial discrimination in any other area of hiring. But police departments already bend over backwards to try to hire minority (particularly black) and female officers. This is nothing more than a quota. Given black males\u2019 disproportionate involvement in crime, there\u2019s a smaller pool of black candidates because a proportionately greater number are disqualified by criminal records. Black males also are less likely to graduate from high school than men of other races. In states with large numbers of illegal immigrants \u2014 such as California, Texas, and Arizona \u2014 the number of qualified Hispanic applicants may for that reason be disproportionately smaller than the Hispanic population as a whole.<\/p>\n<p style=\"text-align: justify;\">\u201cIf a police department doesn\u2019t have officers who \u2018look like\u2019 the community because of a lack of qualified applicants, that doesn\u2019t mean the department has engaged in discrimination. The Supreme Court held in Hazelwood that \u2018a proper comparison was between the racial composition of Hazelwood\u2019s teaching staff and the racial composition of the qualified public school teacher population in the relevant labor market.\u2019 Hazelwood v. U.S., 433 U.S. at 308 (emphasis added).<\/p>\n<p style=\"text-align: justify;\">\u201cThe Court reiterated this holding in Wygant v. Jackson. In Wygant, the school board argued that it was justified in discriminating against white teachers because of the need for minority role models for minority students, and to remedy the effects of societal discrimination. The Court explicitly rejected these arguments. The Court flatly stated that past societal discrimination cannot be the basis for racial classifications in hiring today. In order to justify a racial classification in hiring, there must be a showing of past racial discrimination by the governmental unit in question. Given that government employers have been prohibited from engaging in racial discrimination since 1972, this would be enormously difficult to prove. The Court also firmly rejected the \u2018role model\u2019 theory for racial preferences in hiring, stating, \u2018The role model theory employed by the District Court has no logical stopping point. The role model theory allows the Board to engage in discriminatory hiring and layoff practices long past the point required by any legitimate remedial purpose.\u2019 Wygant v. Jackson, 476 U.S. at 275.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;In the name of \u00a0 \u201csocial justice\u201d police departments will be mandated to abandon race-neutral policies and to actively discriminate to achieve an equality of outcomes if those race-neutral outcomes do not replicate demographics down to a rounding error or less.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;That will not \u201csolve racial discrimination\u201d; it\u2019ll institutionalize it on a national scale.<\/p>\n<p><meta name=\"twitter:card\" content=\"summary\" \/><meta name=\"twitter:site\" content=\"@PoliticHatBlog\" \/><meta name=\"twitter:creator\" content=\"@ThePoliticalHat\" \/><meta name=\"twitter:title\" content=\"The Dangerous Wokeness of the George Floyd Justice in Policing Act\"\/><meta name=\"twitter:description\" content=\"In the quest to achieve 'equity' and 'social justice' to policing, the Left has embraced the concept of 'disparate impact' where any variance in crime statistics involving race vis-\u00e0-vis racial demographic statistics is presumed to be caused by racism.
