{"id":11870,"date":"2016-05-31T00:15:14","date_gmt":"2016-05-31T07:15:14","guid":{"rendered":"http:\/\/politicalhat.com\/?p=11870"},"modified":"2016-05-31T00:15:14","modified_gmt":"2016-05-31T07:15:14","slug":"being-denied-service-for-affirming-reality","status":"publish","type":"post","link":"https:\/\/impeachreno.org\/politicalhat\/2016\/05\/31\/being-denied-service-for-affirming-reality\/","title":{"rendered":"Being Denied Service For Affirming Reality"},"content":{"rendered":"<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;In New York City you can be denied service in any establishment for insisting that a man is a man, or otherwise denying the invented personal reality of &#8220;trans&#8221;-persons by not using their <a href=\"http:\/\/www.nyc.gov\/html\/cchr\/html\/law\/gender-identity-legalguidance.shtml\" target=\"_blank\">preferred personal pronouns<\/a>.*<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;As Eugene Volokh <a href=\"https:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2016\/05\/17\/you-can-be-fined-for-not-calling-people-ze-or-hir-if-thats-the-pronoun-they-demand-that-you-use\/\" target=\"_blank\">notes<\/a>:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">&#8220;So people can basically force us \u2014 on pain of massive legal liability \u2014 to say what they want us to say, whether or not we want to endorse the political message associated with that term, and whether or not we think it\u2019s a lie.<\/p>\n<p style=\"text-align: justify;\">&#8220;We have to use &#8216;ze,&#8217; a made-up word that carries an obvious political connotation (endorsement of the &#8216;non-binary&#8217; view of gender). We have to call people &#8216;him&#8217; and &#8216;her&#8217; even if we believe that people&#8217;s genders are determined by their biological sex and not by their self-perceptions \u2014 perceptions that, by the way, can rapidly change, for those who are \u201cgender-fluid\u201d \u2014 and that using terms tied to self-perception is basically a lie.&#8221;<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Reality is not subjective.\u00a0 Reality is not a &#8220;social construct&#8221;.\u00a0 It is one thing to believe oneself is a man or a woman or any other invented gender, but it is quite another to use the power of the government to force not only businesses, but other patrons to bend their speech to one&#8217;s will.\u00a0 Remind me again just <em>who<\/em> has <em>power<\/em> and <em>privilege<\/em>?<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Volokh just complains that this strikes right at the heart of free speech:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">&#8220;And this isn&#8217;t just the government as employer, requiring its employees to say things that keep government patrons happy with government services. This is the government as sovereign, threatening &#8216;civil penalties up to $125,000 for violations, and up to $250,000 for violations that are the result of willful, wanton, or malicious conduct&#8217; if people don&#8217;t speak the way the government tells them to speak.&#8221;<\/p>\n<\/blockquote>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-11871\" title=\"Four Lights Fries\" src=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2016\/05\/Four-Lights-Fries.jpg\" alt=\"\" width=\"440\" height=\"330\" srcset=\"https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2016\/05\/Four-Lights-Fries.jpg 440w, https:\/\/impeachreno.org\/politicalhat\/wp-content\/uploads\/2016\/05\/Four-Lights-Fries-300x224.jpg 300w\" sizes=\"auto, (max-width: 440px) 100vw, 440px\" \/><\/p>\n<p style=\"text-align: justify;\"><!--more-->&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Unfortunately, Volokh doesn&#8217;t seem to realize that that ship has already sailed.\u00a0 The Gay Wedding cases involving bakers, florists, photographers have already established that when you try to make a living, you <a title=\"Progressives, Thy Name is Intolerance\" href=\"https:\/\/impeachreno.org\/politicalhat\/2013\/08\/27\/progressives-thy-name-is-intolerance\/\" target=\"_blank\">surrender your fundamental liberties<\/a>; or, as a New Mexico Supreme Court Justice noted:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">&#8220;The Huguenins [who were wedding photographers who declined to use their creative talent to celebrate a Same-Sex Marriage] are free to think, to say, to believe, as they wish; they may pray to the God of their choice and follow those commandments in their personal lives wherever they lead. The Constitution protects the Huguenins in that respect and much more. But there is a price, one that we all have to pay somewhere in our civic life.<\/p>\n<p style=\"text-align: justify;\">&#8220;In the smaller, more focused world of the marketplace, of commerce, of public accommodation, the Huguenins have to channel their conduct, not their beliefs, so as to leave space for other Americans who believe something different. That compromise is part of the glue that holds us together as a nation, the tolerance that lubricates the varied moving parts of us as a people. That sense of respect we owe others, whether or not we believe as they do, illuminates this country, setting it apart from the discord that afflicts much of the rest of the world. In short, I would say to the Huguenins, with the utmost respect: it is the price of citizenship.&#8221;<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;This, then, does not just apply to those who <em>serve<\/em> customers, but to the customers themselves.\u00a0 It is a Hobson&#8217;s choice: You aren&#8217;t <em>forced<\/em> to engage in business or shop at one, therefore you can be required to do what you are told because you <em>choose<\/em> to not live your entire life alone in the dark at your home <em>in the closet<\/em>.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;This gets even more bizarre when it involves not just a &#8220;preferred name [or] pronoun&#8221;, but any &#8220;title&#8221; that one demands!<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">&#8220;What&#8217;s more, according to the City, &#8216;refusal to use a transgender employee&#8217;s preferred name, pronoun, or title may constitute unlawful gender-based harassment.&#8217; The label &#8216;harassment&#8217; is important here because harassment law requires employers and businesses to prevent harassment by co-workers and patrons and not just by themselves or their own employees; this is particularly well established for harassment by co-workers, but it has also been accepted for harassment by fellow patrons. So an employer or business that learns that its employees or patrons are &#8216;refus[ing] to use a transgender employee&#8217;s preferred&#8217; pronoun or title would have to threaten to fire or eject such people unless they comply with the City\u2019s demands.&#8221;<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;This isn&#8217;t limited to titles like &#8220;mister&#8221; or &#8220;miss&#8221;, but any religious title, or any other title one associates with an invented gender!<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">&#8220;Or what if some people insist that their title is &#8216;Milord,&#8217; or &#8216;Your Holiness&#8217;? They may look like non-gender-related titles, but who\u2019s to say? What if someone decides that one of the 56 genders is indeed especially noble or holy and that those really are the preferred gender terms? Or even if &#8216;Your Holiness&#8217; is understood as purely religious, \u2026 presumably the same logic that applies to gender-related self-chosen titles would apply to religion-related self-chosen titles.
